Terms of Service

1. Acceptance of Terms

By accessing or using PatentSecure ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

PatentSecure is a patent monitoring and infringement analysis platform that uses AI to analyze patent filings and provide risk assessments. The Service is provided "as is" and "as available."

3. User Accounts

3.1 Registration

You must register for an account to use our Service. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

3.2 Account Security

You are responsible for safeguarding your password and for all activities under your account. You must immediately notify us of any unauthorized use of your account.

4. Subscription and Payment

4.1 Pricing

Subscription fees are listed on our pricing page. Prices are subject to change with 30 days' notice.

4.2 Billing

You agree to pay all contractually agreed fees. Payment is processed by invoice after contract conclusion in accordance with the individually agreed conditions. Contract duration and renewal terms are set out in the contract.

4.3 Refunds

Subscriptions are non-refundable except as required by law or as explicitly stated in these Terms.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any intellectual property rights
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use automated systems to access the Service without permission
  • Resell or redistribute the Service

6. Intellectual Property

6.1 Our IP

The Service, including all software, design, text, graphics, and other content, is owned by PatentSecure and protected by copyright, trademark, and other intellectual property laws.

6.2 Your Data

You retain all rights to data you input into the Service. By using the Service, you grant us a license to use your data solely to provide the Service to you.

7. AI-Generated Analysis & Informational Purposes Only

Our patent monitoring and infringement analysis is powered by automated systems and frontier AI models. The Service is provided strictly for informational purposes only. You explicitly acknowledge and agree to the following:

  • The Service does not constitute legal, strategic, or professional advice.
  • We do not guarantee the completeness, timeliness, correctness, or accuracy of any patent data, alerts, or AI-generated analysis.
  • We are absolutely NOT responsible for any missed alarms, delayed notifications, false alarms, or incorrectly triggered alarms.
  • You must verify any information provided by the Service with qualified patent attorneys before making any legal or business decisions.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT NOTIFICATIONS WILL BE DELIVERED IN A TIMELY MANNER, RELIABLY, OR AT ALL. THE ENTIRE RISK AS TO THE QUALITY, ACCURACY, AND PERFORMANCE OF THE SERVICE RESTS ENTIRELY WITH YOU.

9. Liability

PatentSecure's liability is governed by the following provisions:

Unlimited liability: PatentSecure shall be liable without limitation for damages arising from injury to life, body, or health resulting from a culpable breach of duty by PatentSecure, its legal representatives, or vicarious agents, as well as for other damages based on intentional or grossly negligent breaches of duty. We are likewise liable without limitation under the German Product Liability Act (Produkthaftungsgesetz) and to the extent of any guarantee we have assumed.

Liability for ordinary negligence: In the case of a slightly negligent breach of essential contractual obligations (cardinal duties), liability is limited to the foreseeable damage typical for the type of contract at the time of conclusion. Essential contractual obligations are those whose fulfillment is essential to the proper performance of the contract and on whose observance the contractual partner regularly relies and may rely.

In all other respects, liability for slightly negligent breaches of duty is excluded. This applies in particular — subject to the foregoing provisions — to indirect damages, consequential damages, loss of profit, loss of data, business interruptions, as well as to damages caused by false alarms, missed alarms, delayed notifications, missed deadlines, patent infringements by third parties, or inaccurate AI-generated analyses. The Service is expressly not a substitute for qualified patent attorney advice.

Insofar as PatentSecure's liability is excluded or limited under the foregoing provisions, this shall also apply to the personal liability of PatentSecure's legal representatives, employees, and vicarious agents.

10. Indemnification

You agree to indemnify and hold harmless PatentSecure and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

11. Data Protection

We process your personal data in accordance with our Privacy Policy and applicable data protection laws, including the GDPR. See our Privacy Policy and GDPR page for details.

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Berlin, Germany.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
